The data include litigated patents themselves, a set of random patents matched to the litigated patents, and numerous decision-specific and patent-specific variables. The data combine two separately-gathered data sets, one for district court decisions published in the United States Patents Quarterly (USPQ) and another for appeals court decisions published in the (USPQ). In both cases, decisions span 1929-2006. District court decisions are matched to the first appeals court decision in the case, using the USPQ and case histories from Westlaw. In cases where the district court decision is not published but the appellate court decision is published, the district court decision from the appellate court decision is observed. Hence, the data include many district court decisions that are unpublished.

Variables include information about the patents, such as the date the patent was issued and where in the United States the patent originated from, updates to the patents, and the results of litigation surrounding those patents.

2022-02-07 ICPSR data undergo a confidentiality review and are altered when necessary to limit the risk of disclosure. ICPSR also routinely creates ready-to-go data files along with setups in the major statistical software formats as well as standard codebooks to accompany the data. In addition to these procedures, ICPSR performed the following processing steps for this data collection:
