The National Institute of Justice funded the Urban Institute to conduct this multi-site, mixed-methods evaluation of the impact of the U.S. DOJ-funded Enhanced Collaborative Model (ECM) task forces on addressing human trafficking. Specifically, this study sought to (1) understand the impact of the ECM task forces in identifying and assisting human trafficking survivors and investigating and prosecuting human trafficking, and (2) analyze differences in various task force implementation models (e.g., structure and organization) to understand which task force models and features contribute to prosecutions. In addition, this research sought to understand the investigative, prosecutorial, and victim services practices among ECM task forces; challenges and barriers task forces face in combating human trafficking; and synthesize best practices and recommendations for developing and implementing successful task forces.

This data collection includes three datasets compiled from law enforcement closed case files and organized for analysis by case, victim(s), and suspect(s). The collection also includes a README file describing qualitative data consisting of transcripts from interviews with law enforcement officers and other stakeholders involved with ECM task forces.

Victim Recantation and Disengagement from Prosecution in Intimate Partner Violence Criminally Prosecuted Crimes, Washington, 2014-2016 (ICPSR 38548)

This population-based retrospective cohort study involved current or former heterosexual intimate partners with a misdemeanor or felony-level criminal incident of intimate partner violence (IPV). These cases were referred to and accepted by the King County Prosecuting Attorney's Office in Washington state for prosecution between the years of 2014 and 2016. The ultimate goal of this study was to better inform understanding of the factors that differentiate IPV cases involving victims who disengage from prosecution from cases involving victims who are more engaged (and likely more empowered), thereby better informing how to mitigate barriers and improve overall system response to victims who disengage. This study aimed to provide better understanding of a fuller spectrum regarding victims' needs and vulnerabilities, thereby facilitating provision of more responsive services. The comparison group consisted of otherwise comparable IPV cases that did not, at any point during the prosecution process, involve victim recantation of IPV allegations or disengagement from the prosecution of the criminal IPV case.

This study was designed to address the critical gap in IPV research by accomplishing the following specific aims:

  • Determine the unique and independent factors predictive of victim disengagement with IPV prosecution.
  • Examine prosecutorial outcomes among criminal IPV cases involving victims who disengage from prosecution relative to cases that do not involve victim disengagement.

Indicators of Sex Trafficking in Online Escort Ads (ICPSR 194682)

Although law enforcement and researchers have shared certain escort ad characteristics to detect sex trafficking, such as looking “young” or specific language cues, these indicators do not necessarily predict trafficking when tested against the counterfactual. We examined over 250 indicators in 1,263 ads from four states for which case outcomes were known (positive and negative for trafficking) and held focus groups with trafficking survivors, investigators, and non-trafficked sex workers on indicator meanings and ad posting practices. We found that language signaling a provider is trustworthy, use of an obscured phone number, language suggesting youth, and specification of the provider’s ethnicity were statistically significant predictors of trafficking. Additionally, and importantly for practice, photos in which the subject “appears young” or that displayed visible tattoos were associated more with ads that did not belong to a trafficking case than ads that were related to trafficking. Investigators can apply these results in practice immediately to increase precision in victim identification, and resource allocations can shift to cases most likely to be associated with trafficking, despite the difficulties in accessing such ads because of SESTA/FOSTA and the shutdown of Backpage. Policy recommendations to improve the laws governing advertising websites are also made.

In 2013, the Cuyahoga County (Ohio) Medical Examiner's Office (CCMEO) and the Regional Forensic Science Laboratory developed the Heroin Involved Death Investigation (HIDI) alert system and protocol in response to a substantial increase in opioid-related overdose fatalities. The HIDI protocol is designed to support a safe, coordinated, and rapid response to an active, suspected opioid-overdose death scene, or suspected opioid-overdose deaths occurring at hospitals that are not considered active scenes, by alerting investigators to potential dangers and facilitating the timely protection of scene integrity and evidence collection in order to successfully investigate and prosecute drug traffickers.

The primary goals of the project were to:

  1. Complete extended coding of local medical examiner decedent data--investigative reports and toxicology to identify demographic or geographic trends or patterns of overdose deaths, as well as paraphernalia and evidence present at death scenes that may be useful to prosecutions;
  2. Examine the efficiency of how cases flow through the investigative and prosecutorial stages and how these could be improved;
  3. Identify key variables that may contribute to the successful indictment of traffickers connected to fatal and non-fatal overdose cases; and
  4. Evaluate the implementation and perceived effectiveness of the Cuyahoga County HIDI protocol.

This multi-method project involved three phases of data collection and analysis. First, a forensic epidemiologist coded and analyzed existing CCMEO records for decedent toxicology and death scene characteristics, focusing on drug-related fatalities. Second, county and federal cases prosecuted for drug trafficking, especially those linked to deaths, were systematically reviewed to determine what evidence was deemed important for successful indictment. Third, interviews and focus groups were conducted with key stakeholders from local and federal law enforcement, intelligence analysts, public health officials, and local and federal prosecutors to learn about the HIDI protocol.

The National Survey of Tribal Court Systems (NSTCS) is the first complete enumeration of tribal court systems operating in the United States and gathers administrative and operational information from tribal court systems, prosecutors' offices, and indigent defense providers operating in the United States. The NSTCS helps fulfill BJS's legislative mandate under the Tribal Law and Order Act of 2010 (TLOA; P.L. 111-211, 124 Stat. 2258 § 251(b)) to establish and implement a tribal crime data collection system. Data for the NSTCS were collected by Kauffman & Associates, Inc., an American Indian- and woman-owned management consulting firm, in collaboration with the Tribal Law and Policy Institute.

The National Survey of Tribal Court Systems (NSTCS) consists of three surveys specific to tribal court systems in the lower 48 states, Alaska Native villages, and the Code of Federal Regulations Courts (CFR Courts) operated by the Bureau of Indian Affairs (BIA). Due to data collection challenges and the limited number of Alaska Native villages and CFR Courts that participated in this collection, the Tribal Courts in United States, 2014, report, data file and documentation include information only on tribal court systems in the lower 48 states.

Data for the 2014 NSTCS were collected through mail, email, and telephone nonresponse follow-up. Data on the number and type of tribal court systems were obtained from all eligible federally recognized tribes. The final universe of eligible respondents in the lower 48 states included 234 tribal court systems, of which 196 (83.8%) participated in the survey.

The investigators examined victimization experiences, victim and offender characteristics, crime reporting outcomes, victimization consequences, case processing, as well as the criminal justice system's challenges and opportunities for reform. The project focuses on the hate crime victimization within Miami's Latine community.
