Survey of State Attorneys General, United States, 2014 (ICPSR 37949)

Released/updated on: 2021-05-24
Geographic coverage: United States
Time period: 2014-01-01--2014-12-31

The 2014 Survey of State Attorneys General (SAG) collected information on jurisdiction, sources and circumstances of case referrals, and the participation of attorneys general offices in federal or state white-collar crime task forces in 2014. White-collar crime was defined by the Bureau of Justice Statistics (BJS) as: "any violation of law committed through non-violent means, involving lies, omissions, deceit, misrepresentation, or violation of a position of trust, by an individual or organization for personal or organizational benefit." SAG sought to analyze how attorneys general offices as an organization in all 50 states, the District of Columbia, and U.S. territories respond to white-collar offenses in their jurisdiction.

BJS asked respondents to focus on the following criminal and civil offenses: bank fraud, consumer fraud, insurance fraud, medical fraud, securities fraud, tax fraud, environmental offenses, false claims and statements, illegal payments to governmental officials (giving or receiving), unfair trade practices, and workplace-related offenses (e.g., unsafe working conditions). Variables included whether or not offices handled criminal or civil cases in the above categories, estimated number of cases in each category, and what types of criminal or civil sanctions were imposed on white-collar offenders. Researchers also assessed collaboration with partners outside of state attorneys offices, whether cases were referred for federal or local prosecution, and what circumstances lead to referring cases to state regulatory agencies. The extent to which state attorneys offices maintain white-collar crime data was also recorded.

This study was a two-year panel study of how the receipt of civil legal services provided by Iowa Legal Aid (ILA), influences safety, psychological well-being and economic self-sufficiency outcomes for women who experienced Intimate Partner Violence (IPV) residing in metro and non-metro communities in Iowa. The study looked at both the provision of family law services (divorce, child custody, child support) and CPOs. Also examined was the impact of the quality of the attorney-client relationship on women's sense of empowerment on these outcomes. Five waves of data were collected, starting with an initial assessment interview with four follow-up interviews conducted at 6-month intervals. Information collected includes women's history of IPV, measures of repeat abuse, psychological well-being and parenting, quality of the attorney-client relationship, and empowerment.

Geographic coverage: United States
Time period: 2005-01-01--2010-12-31
The Bureau of Justice Statistics' (BJS) Civil Justice Survey of Trials on Appeal (CJSTA) was based on 26,950 general civil (i.e., tort, contract, and real property) cases that were disposed by bench or jury trial in 156 counties participating in the 2005 Civil Justice Survey of State Courts (ICPSR 23862). Subsequently, 3,970 of those cases were appealed to 84 appellate courts in 35 states. This data collection examines civil bench and jury trials concluded in state trial courts in 2005 that were appealed to an intermediate appellate court or court of last resort. It is the first report based on data collected in the Bureau of Justice Statistics' (BJS) Civil Justice Survey of Trials on Appeal (CJSTA). The CJSTA included information from court records on civil trials concluded in 2005 and tracked the subsequent appeals from 2005 through March 2010. Information collected included the types of civil cases appealed, appeals dismissed or withdrawn before being decided on the merits, and appeals resulting in the trial court decision being reversed or affirmed. The time from the filing of an appeal to final appellate court disposition was also measured.

Civil Justice Survey of State Courts, 2005 (ICPSR 23862)

Released/updated on: 2011-11-02
Geographic coverage: United States
Time period: 2005-01-01--2005-12-31
The Civil Justice Survey of State Courts (CJSSC), 2005 is a systematic examination of general civil (that is, tort, contract, and real property) cases disposed of by bench or jury trial in a national sample of state courts of general jurisdiction in 2005. This study expands on the 1992, 1996, and 2001 CJSSC by collecting a nationally representative sample of bench and jury trials concluded in 156 urban, suburban, and rural counties. Prior iterations of the CJSSC focused on general civil cases concluded by bench or jury trial in a sample of the nation's 75 most populous counties. The 2005 CJSSC was designed and carried out by the National Center for State Courts. Westat designed the national sampling framework for this survey. The data collection produced two datasets. The first contains information on general civil (tort, contract, and real property) cases disposed of by bench or jury trial in a national sample of counties in 2005. Detailed case level information was obtained on these trials, including types of civil cases litigated at trial, characteristics of litigants involved in trials, who wins in trials, compensatory award amounts, punitive damages, case processing times, and post-trial litigation. The other data file contains aggregate information on the number of general civil trial and nontrial dispositions that occurred in 2005 in CJSCC counties that had the capacity to provide these data. This is the fourth in a series of data collections begun in 1992 [CIVIL JUSTICE SURVEY OF STATE COURTS, 1992 (ICPSR 6587), CIVIL JUSTICE SURVEY OF STATE COURTS, 1996 (ICPSR 2883), and CIVIL JUSTICE SURVEY OF STATE COURTS, 2001 (ICPSR 3957)].

In 1996, the Bureau of Justice Statistics awarded a grant to the National Center for State Courts to gather detailed information on tort, contract, and real property rights trial cases in 45 jurisdictions chosen to represent the 75 most populous counties in the nation. The result is this survey, which is a systematic examination of civil trial cases disposed in state general jurisdiction courts. The study expands the 1992 civil jury study, CIVIL JUSTICE SURVEY OF STATE COURTS, 1992 (ICPSR 6587), by specifically sampling bench and jury trial cases. Information gathered includes the type of case, the presence of legal representation, the type of litigation, the amount of compensatory damages awarded, the amount of punitive damages awarded, and case processing time.

The 2001 Supplemental Survey of Civil Appeals is a follow-up to the CIVIL JUSTICE SURVEY OF STATE COURTS, 2001 (ICPSR 3957) which examined 8,311 general civil cases (e.g., tort, contract, and real property) concluded by bench or jury trial in a sample of 46 of the nation's 75 most populous counties in 2001. These cases were then weighted to represent the 11,908 general civil trials concluded in the nation's 75 most populous counties. Data from the 2001 Civil Trial Survey were used to produce several Bureau of Justice Statistics (BJS) reports describing the characteristics of civil litigation in state courts. The 2001 Supplemental Survey of Civil Appeals tracks every general civil case concluded by bench or jury trial in 2001 in the 46 surveyed counties that were subsequently appealed to an intermediate appellate court or court of last resort. In the 2001 Civil Justice Survey of State Courts information was collected for every general civil trial concluded in 43 of the 46 selected counties. In these counties, the 2001 Supplemental Survey of Civil Appeals collected information on all general trials that produced an appeal. In the three remaining counties, (Cook County, Philadelphia County, and Bergen County), the appeals survey obtained information for both those general civil trials concluded in 2001 that were subsequently appealed and, in addition, collected information for those general civil appeals that were not captured at the trial court level. The 2001 Supplemental Survey of Civil Appeals tracks data on general civil appeals that originated from 46 of the nation's 75 most populous counties. Unlike the 2001 Civil Justice Survey of State Courts, cases were not weighted to represent appeals in the nation's 75 most populous counties. The appeals were followed until they were withdrawn, dismissed, or decided on the merits in the appellate courts. All appeals were tracked until April 30, 2005. Appeals not disposed on that date are identified as pending. Overall four appellate datasets were produced from this survey.

Civil Justice Survey of State Courts, 1992 (ICPSR 6587)

Released/updated on: 2011-11-02
Geographic coverage: United States
Time period: 1991-07-01--1992-06-30
This survey is the first broad-based, systematic examination of the nature of civil litigation in state general jurisdiction trial courts. The data collection produced two datasets. Part 1, Tort, Contract, and Real Property Rights Data, is a merged sample of approximately 30,000 tort, contract, and real property rights cases disposed during the 12-month period ending June 30, 1992. Part 2, Civil Jury Cases Data, is a sample of about 6,500 jury trial cases disposed over the same time period. Data collected include information about litigants, case type, disposition type, processing time, case outcome, and award amounts for civil jury cases.

Eurobarometer 68.2: European Union Policy and Decision Making, Corruption, Civil Justice, E-Communications, Agriculture, and Environmental Protection, November 2007-January 2008 (ICPSR 25162)

Released/updated on: 2011-04-25
Geographic coverage: Cyprus, Portugal, Global, Malta, Greece, Netherlands, Sweden, Austria, Latvia, Luxembourg, Ireland, Poland, Slovenia, Slovakia, France, Bulgaria, Lithuania, Romania, Hungary, Europe, United Kingdom, Spain, Czech Republic, Belgium, Finland, Denmark, Italy, Germany, Estonia
Time period: 2007-11-09--2008-01-16
This round of Eurobarometer surveys diverged from the Standard Eurobarometer measures and queried respondents on the following major areas of focus: (1) European Union policy and decision-making, (2) corruption, (3) civil justice, (4) e-communications, (5) agriculture, and (6) environmental protection. For the first major focus, European Union (EU) policy and decision-making, respondents were queried about whether more or less decision-making should take place at the EU level in regards to the following topics: asylum and migration policy, exchange of police and judicial information between member states, the fight against drug abuse, the control of external borders of the EU, the fight against terrorism, and the promotion and protection of fundamental rights, including children's rights. Of these, respondents were asked which topics they thought should be the three priorities of the EU, which topics they felt well informed on, and which topics they would like to be better informed. For the second major focus, corruption, respondents were asked whether they agreed that corruption is a major problem in their country and a major problem in local, regional, national, and EU institutions. They also answered questions regarding how widespread they thought bribery and abuse of power were, if in the last 12 months they had been asked or expected to pay a bribe for services, whether they agreed that most corruption is caused by organized crime, and whose responsibility it is to prevent and fight corruption. For the third major focus, civil justice, respondents were asked if they had ever been involved in civil justice procedures in another EU member state, and what their opinion was about the ease of accessing civil justice outside of their own country. Respondents were also asked if additional measures should be taken to assist in access to civil justice in another EU member state, what their main concerns were about the procedures, and their preference for contract terms in purchasing products in other EU member states. In addition, respondents were queried about whether there should be uniform procedures in the EU for civil and commercial claims, if rulings made in one member state should freely apply in another member state, the main difficulties in enforcing rulings in another member state, if the EU should intervene in the enforcement of civil court rulings between member states, and the usefulness of having access to civil justice in another member state via the Internet. For the fourth major focus, e-communications, respondents provided information on the availability within their own households of each of the following communication systems: television, fixed telephone, mobile phones, and the Internet. Respondents were asked to identify reasons why they owned or did not own certain systems, including television, fixed/mobile phones, and telecommunication bundles, the accessibility of these systems in their household, their use of public payphones and telephone directories, and their knowledge of emergency service numbers. In addition, respondents assessed the performance of each system, shared their expectations as consumers, and rated the effectiveness of their service providers and available features of the systems (e.g., costs, tariffs, and flexibility with account changes). For the fifth major focus, agriculture, respondents shared their opinions about the importance of agriculture in the EU, their knowledge of the Common Agricultural Policy (CAP), whether they wanted more information about CAP, and from what sources they would gather that information. The survey also asked what should be the main priorities of the EU in terms of CAP, how well CAP fulfills its role, and what the main responsibilities of farmers should be. Respondents were further questioned in regard to the EU's reduction of the subsidy for farmers, what their opinions were about trade barriers, and whether the current amount of budgeting for agriculture was adequate. For the sixth major focus, environmental protection, queries included how important environmental protection was, what was meant by "the environment," what were the main environmental issues that worried them, how informed they felt about the environment, what issues they would like more information on, their main sources of environmental information, and who they trusted the most for information on environmental issues. In addition, respondents were queried about the best way to evaluate progress in environmental protection, the comparison of environmental protection versus economic competitiveness, personal efforts to protect the environment, what should be the priorities of citizens in daily life, and how environmental decisions should be made by government and by public authorities. Further questions included what the most effective way to tackle environmental problems should be, whether an EU civil protection force should be set up, and their opinions about the labeling of environmentally friendly products and the use of genetically modified organisms (GMOs). Demographic and other background information includes age, gender, nationality, origin of birth (personal and parental), marital status, left-right political self-placement, occupation, age when stopped full-time education, household composition, ownership of other durable goods, Internet use, type and size of locality, region of residence, and language of interview (in select countries).
